Tier 2 ICT and CoS Cancellation

Hi All,

I have query regarding T2ICT. So, I'm on a short term T2ICT visa which expires in end of Sept 2017, travelled from India to UK.
1. I would be leaving my current organization on 28th April, how long after that can I stay in UK? I understand from some posts, it is 28th April + Curtailment period? Is that correct?
2. Does the same curtailment period apply to my dependent as well? Can he/she continue to work with their current employer during that curtailment period?
2. I understand I can switch from T2ICT to T2ICT Dependent visa during that curtailment period without moving out of UK? Is this correct?
3. If answer to point 2 is yes, If I'm able to find another employer during the curtailment period, can the new CoS be issued or my new employer will have to wait for me to move to T2ICT dependent visa before he can issue the CoS?

Any help would be much appreciated?

You seem confused. How can you move to ICT Dependent if you are the main ICT visa holder?

You will be subject to a 12 month cooling off period before you can apply for Tier 2 General. I am not sure why you keep saying ICT dependent??

3. Assuming that, my spouse get a fresh T2ICT from the employer (going back to India and getting a new Visa), I understand I can switch from T2ICT to T2ICT Dependent visa during that curtailment period without moving out of UK? Is this correct?

1. 30 days.

2. Yes

3. She cannot apply for an ICT visa. The requirement for ICT is that she must have worked for the sponsor in her home country for 12 months. She can try Tier 2 General. You can switch to Tier 2 General dependent if she gets a visa and returns to the UK. You must have a valid visa to do this.

4. No. You will be subject to the 12 month cooling off period before you can apply for Tier 2 General. That is either 12 months in home country or 12 months on Tier 2 General Dependent.
