New member - quick hello, and......

Hi everyone,

as the title suggests, I'm a new member here, I'm a british citizen, born and bred british bloke!!!!!

I recently got married to my gorgeous wife in Florida, she is a US citizen.......well i'm guessing you know the next bit, anyway......

.....after lots of chats between us, we have decided to "TRY" and get her over here on a spousal visa, I've spent the last weeks investigating, and researching, and what a nightmare this is...

It would appear that I would not qualify to sponsor her, here's the short story:

I run my own business (It's a limited company - i am the director) but don't earn the required £18,600 (or whatever it is) nor do I have enough savings to match the figure (the shortfall = 2.5 x £1) I am both my parents primary carer, and have been for the last 4 years......and no I don't claim carers allowance, didn't even realise there was such a thing until a few weeks ago.

My wife is degree qualified - Associates of Science in Business admin with a legal specialisation.

As you can imagine, my brain is about to explode with all this, I spoke with an immigration lawer (adwords advert) who told me plain and simple that based on my situation/information i gave, I just wouldn't qualify :-(

So, is there any advice anyone can give me on where I turn now, as I said I'm just an ordinary "bloke" with experience amounting to only my research in the last few weeks on this immigration subject.

What on earth do I do next???

If you claim certain benefits, including carers allowance (even for a month or two), you are exempt from meeting the financial requirement and only need to meet the 'adequate maintenance and accommodation' requirement.

Apologies, I have another question.....

Can my wife come over here on a tourist visa, for 6 months while we wait for a decision on the spousal visa, or for instance before we apply for the visa??

I know she can't work, but if I can't spend time with her it's going to drive me crazy.

I realise if the visa application is refused, she will have to go back, but it seems like a mad situation that I can't spend time with my new wife, this really is a painful situation :-(

Are you aware that your wife won't be able to apply for a spouse visa from within the UK while she is here as a visitor?

no I wasn't aware of that, so I'mguessing we have to applyfor the visa first, then is it ok for her to come over on a tourist visa while the application is being processed?

Your wife won't be in possession of her passport while the spouse visa application is being processed.

oh you're kidding me??? this really is driving me nuts, I can fully understand the vetting process, and indeed the need, but it seems a crazy situation,and i reqally don't know what to do now
