Tier 2 General visa switch from Tier 2 ICT short term

Hi ,
I would like to ask some questions from Tier 2 ICT to Tier 2 General.

I came to UK on January 2016 in ICT short term visa and came back to India on December 2016 . My Visa got expired and I quit my company now.
Am getting an offer in UK for niche skill. So that company is ready to follow the actual process of giving advertisement for a month and If there is no response from other employees , They can apply for Tier 2 General for me.Will Home office accept my Application?

Am I eligible to come back to UK in Tier 2 General now? Please provide me some clear view on this query which will be more helpful.

You are subject to the 12 month cooling off period unless you earn in excess of £155k with your new sponsor or possibly depending if job is on the shortage occupation list.
