Tourist visa application to Spain for British spouse

Dear All,
I am travelling to Spain with my wife and my son. I and my son are British while my wife is Indian and staying on ILR in UK. My wife is going to apply for tourist visa for Spain at 3rd April 2017. If my wife apply for visa to Spain, does her application come under EU family members visa category? Please give your suggestion. Thanks in advance.

It should, if your marriage certificate is legalised and apostilled.

Mine wasn't when I applied so I had to apply as a normal tourist with all the necessary bank statements, travel insurance etc.

CR001 thanks for post. Our marriage certificate is generated in india. Is it valid?

Any marriage cert is valid, but the Spanish embassy told me that to get a free visa as EU spouse, it must be apostilled by my countries relevant authorities. Apostille, if you Google it, is a certification pasted onto the back of a document. The correct term is Apostilled in terms of the Hague Convention (I think).

I would strongly advise you to, get your Indian marriage certificate apostiled, I think you should get it legalised first from the Indian state government where the marriage was registered and then Ministry of external affairs will apostile the marriage certificate.
