Am I eligible to claim benefit

Good Morning.

I am an Indian passport holder. I am married to a British National. We have two children age 3 and 1 both British National as well. We got married in 2013. At the moment I am on spouse visa which ends in Aug 2018 and then I need to apply for ILR/Naturalisation. Due to problem in our marriage, I need to leave my husband's house with my two kids and seek for council housing and child benefit help. I am not sure if I can claim any of that. What other public funds I can claim as a single parent? Please help me to know my rights as a single mum with two British National kids. Just to let you know I am not divorced yet.

You cannot claim ANY benefits and unlikely to get a council house either.

You also cannot remain on your current visa. Your husband must inform HO when the relationship breaks down and you separate and your visa will be curtailed/cancelled. You will not be able to apply for ILR if your husband doesn't support your application and if you are no longer in a subsisting marriage.

You will have to apply in another visa cateogory if your spouse visa is cancelled.

Is it just normal marriage problems or is there domestic abuse?
