Hello Everyone,

I have always been a silent member and finally, trouble found me in the end. I'm sure someone could learn something from my case too while others could offer kind and much-needed advice.

I applied for FLR(M) on 12 of March 2017
My wife was on Tier 1 - Entrepreneur and I was her dependent.
She received her IRL on 23rd of February 2017
For FLR (m) Income is shown over 34k through our own company. (Hers 19k and rest was mine)
* The application for FLR(m) from Liv PEO wasn't successful on the day and asked for further evidence. Para - 9 (c) on guidance asking 1kg worth bank statements ton of other company docs. All submitted on 17th.

* Now I have once in a life time dream job offer. BUT I have no documents on me! I'm supposed to start on Monday the 10th and my recruiter is extremely uneasy about the situation.

My questions are,

1) Employer checking service - How accurate they can be? I heard a lot of negative results been given.
2) Can I go back to PEO and ask them for documentary evidence of on-going application?
- I only have a letter stating they required further documentation and a list of documents.
No mention of Tier 1 visa and continuing work rights.
Writing to them for an update will not be quick enough for 10th April start date.

Please let me know what are my options are.

Without your passport and a valid visa, just about impossible to start a new job to be honest.

Fairly accurate providing the check is done at least 5 days after your application was submitted.

Does your letter you received have a reference number on? Did you get a letter at PSC on the day that your application is being held for further checks? Still doesn't change the fact that you don't have your documents and visa yet.
No mention of Tier 1 visa and continuing work rights.

If you applied for FLR(M) before your Tier 1 expired, your existing work rights continue under Section 3C. A new employer however has no obligation to employ you based on this or the ECS check though.
Writing to them for an update will not be quick enough for 10th April start date.
All you can do is wait or negotiate with your new employer to start later etc. Still doesn't solve the problem that you have no documents.

Thank you CR001 for your swift response.

There is a case number on that letter I've received from PSC which I passed onto my recruiter. Yes, Its seems merely impossible to start the job without the documents.

My solicitor was pretty adamant about his experience and capabilities and was sarcastic and upset when I questioned why and why nots.. If I had completed my application on my own I would have included company details along with the application. Any way...

Can we make visits? and ask for a letter stating my right to work continues? (update) I know this sounds silly but I am very much a desperate man at this point and willing to brush all of their shoes if I had to.

No, you cannot just arrive at the PSC to ask for a letter. Any communication from HO will be by post.

Suggest google section 3C but convincing a new employer to hire you is the challenge you face.

Even if you use a solicitor, the applicant is SOLELY responsible for their application. A solicitor has no influence or effect on your application so not sure why you chose to use one for what appears to be a relatively straightforward application.

When did or does your Tier 1 Ent dep visa expire?

Last 3 Qs,

1) Do you have the ECS contact number?

2) Usual turnaround time in this category after additional documents submission?

3) Will I be given appeal rights if rejected?

It is an online system for employers to check. New employer will still need your original documents.

A few weeks, maybe a couple of months. It varies.
3) Will I be given appeal rights if rejected?
Possibly not. You should get the option of Administrative Review though.

So far no decision. The worrying bit is no CSE either, its pass the due date and I emailed them twice on this delayed CSE and had no response.

CR001 - With all due respect this is specific to me and the other thread could offer valuable information for others who are going through same immigration sequence.

ie : If I had come across similar thread prior to my visa submission I wouldn't have to go through the agony I'm in right now.

Submitted in Person : March 11th

Additional Documents Submitted : 17th March

Documents received on : 20th June.
