Dependant Spouse and Tenancy Agreement

Hi all!

My husband who is on Tier 2 - Dependant Visa has been here living in the UK for two months now. Is it necessary for him to be included in the tenancy agreement? He is still looking for a job and currently is not contributing to the rental share. We live with two other people in the flat.

Adding him may be useful for various purposes, especially if he doesn't have any other local ID/address proofs... but it's not mandatory I believe (going with CR001's input as he is much more knowledgeable on this forum)
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Thank you, srsw and CR001!

Our agent though has said that our landlord is expecting for me to include my husband in the tenancy agreement when he arrives here in the UK, which means we will need to revise the tenancy agreement which will cost us £400. Can you give me any UK government site stating it is not necessary to have dependants included in the tenancy agreement to support me if I need to contest this to the agent?

If agency is involved then they generally put such clause that only named persons can reside in the property. And any changes to agreement, they tend to add cost saying they need to do background verification etc. so you may not have much choice in that instance if you signed on the dotted line already.

Check your existing tenancy agreement and you will find these clause for sure.
