FLR (M) category swtich

Post by aftab204 » Wed Apr 05, 2017 11:11 am

Hi There,
I got my ILR Sep 2014 before that i was on Tier 2 visa for 5 years, my wife got entry clearance from Pakistan in 2013, she switched to tier 2 (Dependent) visa in May 2014, her tier 2 dependent visa is expiring May 2017.
Our solicitor said she should have to switch to FLR(M) when you got the ILR, is that the case? or now she can switch to FLR (M) with our any problem?

Please reply.

Thanks

If you got ILR based on Tier 2 and 5 years residence, your wife can continue to extend her PBS visa till she meets the requirements for ILR. She will get a 3 year extension.

Your solicitor is wrong. Switching to FLR (M) is only mandatory for main visa holders who get ILR based on 10 years long residence.

Thanks alot for your reply .
That's exactly I thought I was on 5 years work permit route,
She got three years dependant visa and she should get two years extension to complete her 5 years route.
Kind regards

She will get a 3 year extension. She cannot apply for less than 3 years.
