Tier 2 ICT and Dependent Tier 2 General

Post by Joshua121 » Mon Apr 10, 2017 10:16 pm

Hi All,
I came to UK on January 2017 on Tier 2 ICT(3 years) with my spouse on dependent visa.
She has recently offered employment and Tier 2 General Visa with 55k pa salary

Please advise if I can switch to Tier 2 General Visa and can plan for ILR after 5/6 years

Josh

Do you mean 'switch to Tier 2 dependent' :?:
(Casa, not CR001)

She will need to apply from home country. Hope her employer has completed a proper RLMT

No, you will be suject to 12 months cool off period. You can only switch to a Tier 2 General dependent visa if required. This should help you with an ILR provided your spouse qualifies in 5 years

Yes.Teir 2 dependent.

Thanks poper.

One correction. She was offered the job based on the dependent visa. Can she move to Tier 2 General Visa

Or any other visa which will lead to ILR

She can move to Tier 2 General but has to apply from your home country. T2G will lead to ILR after 5 years

Thanks RubyRacer.

Please advice if the employer agrees for T2G
  • Does she has to travel to india for visa?
  • Is RLMT required ?
  • Will the time spent on T2 ICT counted after getting
    T2G for ILR?

  • Does she has to travel to india for visa? Yes, this has been confirmed more than once already in this thread, i.e. apply from home country
  • Is RLMT required ? Yes, to prove that she is not 'pre-selected' and that no other person with ILR/BC or EU cit can do the job.
  • Will the time spent on T2 ICT counted after getting T2G for ILR? No.
Char (CR001 not Casa)
