PBS dependent eligibility for ILR

Hi All,

I have got citizenship in 2016 and before I was on Tier 1 General.

My wife’s PBS dependent visa expires in June 2017, last extension was for 3 years in June 2014 and before that she was given PBS dependent first time in 2012.

She came to UK in Oct 2012 although her visa was issued from Aug 2012.


Please confirm

Should she get extension now from June 2017 for FEW month only?
And apply for ILR in Oct or Aug 2017?

On what date did she APPLY for her original PBS Dep visa?

PBS dependent applied first time on 25th July 2012 and got it from 1st Aug 2012 validity till July 2014.

Also, please confirm when is the ILR eligibility? Aug (5 years from 1st time visa granted) or October (5 years from 1st time entered in UK).

October. Date of entry is the starting point. No sooner than 28 days prior to the 5th anniversary of her initial entry.

Thank you for confirmation.

One last question, after getting ILR in this 5 years route as PBS dependent, will she has to wait for 1 year for naturalisation? as I have citizenship since 2016, can she take british citizen spouse route and apply for naturalisation within couple of months after receiving ILR?

She can apply for citizenship as soon as she is granted ILR and has her BRP card, provided she meets ALL the requirements based on 3 years residence, including being physically present 3 years ago on the same date she applies for and the absence limits.
