Applying for a Spouse Visa - Current one Active

Post by wellwellwelly » Wed Apr 19, 2017 12:12 pm

Good afternoon all

I am hoping someone may be able to confirm my situation.

Me and my partner were accepted for a spouse visa previously which is due to expire in July.

We have been living apart for a while which means that we cannot apply for the extension on this visa. She is currently living in her home country and I am living in the UK.

We will be starting the 5 year route again at the end of this month (applying to join family living permanently in the UK)

Will the current active visa affect the application, or will the application simply override the existing visa?

I hope this makes sense.

Thank you

You were required to notify the HO of your separation who would then take the appropriate actions to curtail the visa.

Hello, thank you for your reply.

Will any action need to be taken at this point with the HO? We have since repaired our marriage and she has visited the UK. Will a statement or letter need to be provided when submitting our application?

Thank you again.

If you did not report the separation to HO, no point in doing so now.

When did spouse leave the UK?

When did spouse visa and for how long? Was this on the spouse visa or a visitor visa?

What date exactly does the spouse visa expire?

What evidence of communication do you have while spouse has been in home country?

She left around November 2015 and came back in June 2016 for two weeks, we have since been been in daily contact with each other.

The visa is a spouse visa which is due to expire in July this year.

Thank you

Whatsapp communication and telephone calls, birthday / christmas cards.

She visited on her spouse visa for 2 weeks in June.

Thanks
