Hi

I will be applying for ILR as a spouse of a British Citizen on 5 years route (Without any Children). I applied as a spouse after 09th July 2012 for the first time as spouse of settled person (ILR) and second time extended the spouse visa as spouse of British citizen (Naturalised) so need advise on category to apply. When checking out eligibility on the gov site:- it separates out applying as partner of settled person to British citizen. Also would like some advise on satisfying financial requirement.

As per Home Office website it says that

If you’re on the 5-year route you’ll need to prove you have at least:
£18,600 for each year for you

1. Does this mean that I have show income of £18,600 * 5 at the time of applying? Is this household income?
2. What if I and my spouse did not work for specific period and may have short fall of few months ? Example in a year we both worked only 4 months?
3. How does the year count for financial requirement? If I got my visa in July 2012 then would year be July to June or Jan to Dec and prorated at the time of application?
4. Can savings be considered against financial requirement?
5. What is the total amount required at the time of application?

It is the same visa category regardless of ILR/BC status.
If you’re on the 5-year route you’ll need to prove you have at least:
£18,600 for each year for you
Fairly certain it does not state '....FOR EACH OF YOU'!!

You need to evidence the income at the time of application in the same way you did when you applied for an extension, i.e. 6 months payslips/bank statements.

There is NO requirement to evidence 5 years worth of income. You are overthinking this point.

Count backwards from date of application. Different for limited company directors income though.
4. Can savings be considered against financial requirement?
Yes, but first £16,000 will be not be considered as far as I am aware.
5. What is the total amount required at the time of application?
6 months evidence of salary/bank statements at £18,600pa or £9,300 pro rated. Not sure about savings calc for ILR.
