A few ancestry visa related questions

Post by Overfinch » Thu Apr 20, 2017 5:13 pm

Hi all, long time lurker but first time poster here.

Apologies in advance for the long post I have a few questions regarding ILR and Citizenship after living here for 5 years on my ancestry visa. I moved to the UK in 2013 on a Tier 4 Student Visa (I lived here for a year before this as well on a student visa in 2009). Last summer I had an internship offer and went home and applied for and had my ancestry visa approved. I came back to the UK and completed my 3 month internship and was offered a grad job for the following year after finishing my final year at university. This means I have about a year of not having work, but having a job offer which needs me to spend that year getting my degree. Does anyone have experience with this? Will I have trouble getting my ILR application approved when the time comes in 4 years because of this? (Assuming I'm in constant employment until then).

My second question is, if I am married to a British Citizen, do I have to wait 12 months after getting ILR to apply for citizenship or can I apply immediately? Since my ILR would be based on my ancestry visa rather than a spouse visa?

Looking forward to hearing if anyone has similar experiences with either of these situations! Thanks in advance

1. You should be fine. You can of course work part time too.

2. No you don't have to wait the 12 months to apply for citizenship. As soon as you have ILR, you can apply based on 3 years residence Spouse of BC section 6(2) citizenship app.

Thanks for the quick reply! I should start working full time in September now. I did not need to work full time due to savings, internship income etc. and instead wanted to focus on my studies to make sure I met the requirements of my job offer. I just hope that I don't get into trouble for using the visa primarily to study for a year - hopefully the fact that I had a conditional job offer which needed me to finish my final year of university will be sufficient.
I think I may just be a bit paranoid because of it seeming to constantly get more difficult to acquire citizenship. Can't wait to finally be able to apply for ILR and citizenship in a few years time!

Internship income is income/work. Don't stress, you will be fine.
