Need advice regarding my partner, who is currently an AS

Hello,

I have been with my partner for five months, and am wondering about the legal issues concerning taking our relationship to the next level.

I am planning on popping the question to him but am quite worried since he is currently seeking asylum and waiting for the response to his claim.

I want to know upon his agreement and becoming my fiancé, what would happen regarding:

1. My home, since it is a housing association property, I am the tenant, and hold an assured tenancy.
2. My council tax, since it would obviously change. The property is a band F in RBKC.
3. What would happen to his asylum claim, since would it be better for us to apply for a spouse visa, or can he even do so since he is already an asylum seeker in the U.K. As he would be able to work as I understand etc.

Please advise on the best course of action.

Don't you think that it is a bit premature to get engaged with someone who is an asylum seeker just after five months? You seem to have a lot to lose. Your relationship needs to be genuine and having lasted for at least two years for a Visa.

This is ONLY a requirement for an unmarried partner visa. It is not necessary if they are able to marry.

The two year rule only applies to unmarried couples. And I do not think it's premature at all, there are cultural and social norms that would frown upon us waiting for this long.

If you could provide me with advice regarding my situation I would be grateful.

The relationship is genuine, and there is sufficient proof in that regards.

Your main issue may be in getting permission from the Home Office to marry in the UK.

You will only be able to give notice to marry with a HO designated Registry Office. The Registrar is then legally bound to notify the HO who can then extend the notification period from 28 to 70 days in order to interview you both separately before the wedding can go ahead.

Your partner will also have to show his passport to the Registrar, which I guess may be a problem?

Neither will marriage give him any legal status in the UK.
