Sponsor Question - section 2 EEA(PR)

Post by allstar » Sat Apr 22, 2017 1:39 am

Hi everyone

I'm beginning to get confused by this sponsor section - I hope someone can help, any assistance would be much appreciated as i'm just seeking clarity as to when section 2 would actually apply - as a heads up, I don't think it applies to me but just want to confirm!

I'm applying for PR myself as an EEA national. I have lived in the UK for 10 years. 5 of those as a student. The most recent 5 years i'm stating as self-sufficient (I receive a monthly income from my dad to cover costs and living) and have not been employed nor searched for employment. My dad is an EEA national (lives abroad and has never lived in the UK). He is not part of my application and is not applying for PR, i'm the sole applicant applying for myself as an EEA national.

Am I just getting confused with the terminology of sponsor here? - i.e. my dad is sponsoring me financially, but I don't think this what the section 2 'sponsor' is technically looking at? My understanding is that this section does not apply to our relationship. Am I right I thinking it looks at a situation where a person has come to the UK and acquires residence by relying on another EEA national with PR in the UK or British citizen? As an EEA national I have my own right of residence in the UK and am not deriving it from him or anyone else in any way (i.e. i'm not applying as a family member/extended member - I don't derive my right of residence from him as i'm an EEA national having satisfied the criteria anyway)? If i run along this shaky guidance and analysis I don't think I need to complete section 2 and it looks like I can cover off my finances in section 9.9 (self-sufficiency financial resources)?

Any thoughts would be greatly received. Am I completely wrong? Do I derive my right to reside in the UK from my dad as a sponsor?

Many thanks for your help - think I've over-analysed this bit!!!

Your father can only be your sponsor if he was living and working in the UK.

Have you held CSI (comprehensive sickness insurance) as a student or self sufficient person?

Thanks CR001. Yes have held CSI for the last 10 years.

Yes so on the basis my dad is not living and working in the uk i wouldn't consider him a sponsor under the definition in section 2. So, the question is can i still apply in my own right as self sufficient without completing section 2?

Many thanks

Yes, if you have held CSI for the whole time.
