[Help] Husband on spouse visa won't divorce before settlemen

Post by AliceEin » Mon Apr 24, 2017 8:34 am

Hi everyone,
I need some genuine guidance because I'm trapped.
I am British.
My husband is on his extended period visa and our relationship has broken down.
However he refuses to divorce, he said he has put in all financial effort to come to be with me in the UK which is true, so he says I can't left him like that even I offer him money.
We each put in 100K in a property, and he said even 200K won't be enough unless I let him get his Settlement visa first - meaning I need to continue this marriage for another 2.5 years
I am already 29 with no child, I want to meet the right one and have children while it's not too late for a woman's age.
But now I can't get rid of him... what should I do

Are you British and he is on a spouse settlement visa?

As his sponsor, you are required to inform Home Office on the prescribed form that the relationship has broken down and is no longer subsisting. HO will then do whatever processes they do and his visa will eventually be curtailed/cancelled. If you DO NOT support his application for Indefinite Leave to Remain in 2.5 years, his application will fail. For ILR, evidence and proof of subsisting marriage is also required and you also are required to sign the form.

This is not the forum to ask for divorce advice. Suggest contact your local CAB office.
