A Dependant University Education

Hi guys,

I am currently on Entrepreneur visa due to expire in Dec 2017 and my child (18+) will start university in Sept 2017. Please, can you advise if he would be considered for admission without requiring him to go back overseas to make the application since the course is about 3 years and the fact that the visa will expire soon? Although, I intend to renew my Entrepreneur or apply for ILR in Oct 2017. But, I would need her admission letter to apply for her leave to remain as a dependant under family life after I have been granted indefinite leave to remain. I need your help on these options.

On what basis will you be applying for ILR (5 years T1E or 10 years long residence)?

Unlikely a 'family life' application will be successful when a Tier 4 could be applied for.

Why not apply for ILR for based on tier 1?? If child has been dependent on you for 5 years, they will qualify for ILR.

I can only apply to renew my Entrepreneur visa in Dec 2017, but I also have the option of applying for ILR (10-year long residence) in oct 2017. I guess if my ILR (10-year) is successful in Oct 2017, my daughter (18+) could apply for leave to remain under outside the immigration rules as a result of family life (FLR-FP). But she would need may be an admission letter or probably started her education in order to support her application for the leave to remain.

I suggest not to put your hopes on a FLR(FP) application. They are not easy visas to get, especially as a young single person with only 5 years residence. She needs substantial reasons to qualify for this visa. This is NOT a 'magic ticket' visa.

You really are putting her future in the UK at risk with a FLR(FP) application and it can take months and if refused, a blemish on her immigration record.

HO can very well take the view that she can apply for a student visa if she is going to study.

She will be classed as an international student with higher fees anyway as she doesn't hold ILR.

Thank you. I came as a student in Oct 2007 and transitioned into PSW in 2012 and Entrepreneur visa in 2014. My child (18+) joined me in Nov 2012 as a dependant of PSW and due to start university in Sept 2017. However, the Entrpreunr is due to expire in Dec 2017.

So again, why can you not renew the Tier 1 Ent visa? The university can do a status check if necessary and as long as your daughter submits evidence that an application is pending, it shouldn't be an issue.
