marriage referred to home office

Post by davelmb » Fri Sep 02, 2016 3:00 pm

hello there.
Anyone knows much about marriages in the uk? me and my partner who is a non EEA national have been planning to get married this month. we have been to the register and our proposed marriage marriage has been referred to the immigration, as that's the law when marrying a non uk national to tackle sham marriages. the notice day was meant to be 28 days but will be extended to 70 days now because I guess they believe we are not in a genuine relationship and we need to be investigated. but my main concern is my partner's stay in the uk is coming to an end before the 70 days are over and that's worrying us. what do you think we should do? are we gonna be able to marry after the 70 days notice period are over even tho my partner stay will have expired by then? I can't imagine life without my other half. If I did not have kids, it could have been much easier to start a new life abroad. I need some advice please, if you want to be to judgmental, please do not leave a comment as that won't be helpful. thanks

Its routine, nothing to worry about at this stage.

Immigration status of both parties?
What is that visa that comes to an end soon?

The HO may not delay the decision as long as 70 days, although as your partner's visa is close to expiry they are more likely to decide to interview you both before the wedding can go ahead.

If you are unable to marry and (most importantly) submit an application for FLR(M) before your partner's visa expires, it would be wise for him/her (you don't say which) to apply for a fiance visa from their home country rather than remain here as an overstayer.

Bear in mind that it's the submitting of the FLR(M) application that ensures they retain legal residence while the application is being decided...not the marriage.

Hi there.
thanks the replies. my partner is currently on a tier 4 student visa. and does not work at all.
so we might be unable to meet the financial requirements to apply for the flr(m). what is best thing to do now? the home office has not been in touch with us yet as the investigation is still going on. what can we do?

annual income is 15,500 at the moment. My partner has been unable to get full time employment due to the restrictions on the tier 4 visa. but my partner has been receiving scholarship from a sponsor that has been supporting financially during term time ( about £1000 per month).

Being married doesn't mean that you are exempt from having to meet the 18.6 requirement to sponsor.

How were you planning to sponsor her if you did marry before her student visa expires?

You should have sent a valid passport. The form clearly states that you need to send a valid passport.

Are you the applicant or the sponsor?

When did it expire?

Why hasn't it been renewed first?

Did you or your partner (not sure who posting as the applicant here) apply Before the student visa expired?

How long has the partner with the student visa been in the UK?

Did you and partner manage to get married or not?

Hi. The home office will write to you that you have an invalid application and will give you 10 days to respond with a valid form of ID. This includes national ID cards. You should apply for a new passport, embassays cannot refuse this and if they do, inform the Home Office if they write to you.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.
