Query: ILR for Tier-1 Dependant. Main Applicant now British

Post by magikk » Tue Apr 25, 2017 1:26 pm

Hi All

This forum is doing a great job already and hope it helps me understand some stuff as well.

So I came to UK in July 2010 as TIER1, obtained a Tier 1 extension in 2012, got ILR as Tier 1 in 2015 and accepted british citizenship in 2016.

My wife obtained Tier 1 Dependant visa on 17-12-2012 valid until july 2015 and arrived in UK on 10-2-2013. In July 2015, we obtained a PBS dependant visa valid until June 2018.

So she will qualify for ILR on 10-Feb-2018 as all her 5 years would be as Tier 1 and PBS dependant.

Somebody told me yesterday that she can apply for British citizenship the day after she obtains her ILR because I am a British citizen and she don't have to live on ILR for 12 months. That was like music to my ears but I wasn't sure. Can somebody please confirm me this.

Also can we apply for her ILR after 17-12-2017 as she came here within the first 90 days or is that not the case ?

Thank you to the the people running this forum.

Yes she can, as the spouse of a BC and it will be based on 3 years residence and she will need to meet all the requirements for that.

No. Her residence starts from date of ENTRY to the UK and NOT visa issue date.
