Please advice on obtaining citizenship

Post by seansilva » Tue Apr 25, 2017 4:04 pm

Myself
- holding 5 years EEA2 RC from [March 2013 - March 2018]
- married to an EEA national on December 2012.
- eligible to apply for PR on December 2017.

My Spouse
- My EU spouse obtained the EEA3 PR on March 2016.
- eligible for apply for BC now.

Please advice.
1. What's the quickest and or cheapest path to my citizenship?
2. Is it better if my spouse wait till I get the PR and then apply for her BC and finally I apply for my BC?

* Please assume BREXIT implications didn't apply, when you answer. thanks.

No cheaper route.

You will first need to acquire PR and then once your wife has been granted BC you can apply for British citizenship. If your wife is not a BC you will have to wait for 12 months before qualifying for BC.
That's assuming you meet all the standard requirements, including UK absence limits and good character.

Thanks Casa.

Is it possible for us to apply at the same time periods? [me PR and my wife BC]
or does she have to wait till I get my PR?

Your wife should definitely wait until you've acquired PR as she will be unable to sponsor you under the EEA Regulations once she is a BC.

I will advise your wife to wait until you apply and get your permanent residence before she applies for British Citizenship. If your EEA wife should apply for British citizenship now it would be very difficult and expensive for you to apply for permanent later. The HomeOffice will not allow you applying for permanent residence under the EEA Regulations of 2006. You would be asked to apply for Indefinite Leave to Remain under the immigration Rule as a spouse of British citizen and your wife (now British) will be your sponsor with at least £18,600 threshold. Aside from this, the application fee is more (0ver £1, 200).

Be careful.

Correction. The OP will not be able to apply for ILR under the Immigration Rules if his wife is granted British citizenship before he has acquired PR.
Neither are the Home Office likely to grant a FLR(M) visa and the OP will be without valid leave.

You are eligible to apply for Permanent Residence in March 2018 and not December 2017.

December 2017, 5 years from date of marriage assuming the OP was in the UK at the time of marriage.
