HELP - Notification to a person who liable to be detained

Post by kinghenry11 » Wed Apr 26, 2017 4:25 pm

I got this letter from an old lawyer a few days ago.
--
A. You are a person who is liable to be detained because
A [X] You are a person without leave who has been served with a notice of liability to removal, or ...

--

The problem, is that I have an expired passport, with "certificate of entitlement to the right of abode" this seems to be a major error. I'm i wrong? - I've been living here, going to school for the past 13 years.

with that said, we're at the end of obtaining a status letter confirming status as British citizen, so I really don't know what to think/do about this recent notification.

with "certificate of entitlement to the right of abode"
This expires with the passport. You have to apply for it again when you get a new passport.

That's where it gets confusing. The status of the ROA doesn't expire. So i have absolutely no idea on what to expect.

How did you acquire the Right of Abode? Are you a British citizen? If not, were you born before 1983 and held Commonwealth citizenship AND a separate Right of Abode continuously since then?
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

We acquired it through our father, a british subject, by descent. Our status is still waiting to be confirmed. I was born after 1983.

Thanks for trying to help.

I went to the home office and they've "retracted" that letter "informed" the office who sent it, about our status.

Well done. You are right. A CoE-RoA, like a British passport, doesn't confer the Right of Abode status, but is evidence of it. A person with the Right of Abode cannot be subject to leave.

However, note that new employers or landlords may expect current documents.
