Spouse visa renewal - Tax credit hAve adverse effect?

Hello,

I need to apply leave to remain my Spouse visa renewal end of this year. Since my husband last year the annual income below 18,600 then he applied the tax credit until May 2016. He did not claim after May since his annual income over 18,600 pounds.

May I know will it affect my visa renewal? We did not know it has adverse effect until the lawyer told us abt this.

Can somebody give me more advise on that.

No issue, provided he claimed tax credits in JOINT names with you and NOT as a single person.

Hello,

Thank you very much your prompt replied.

Yes. My husband claimed the tax credit was joint name. Not his single person.

May I know what is the different between using joint name and his single person name? Also, we did not claim it since from Jun2016, we just need to mention on the application form if have a question to ask about this?

The form asks what benefits you are claiming at the time of application. If you are not claiming now then it would be no to the question.

Claiming tax credits as a single person when married is fraud.
