Restrictions on Tier 2 dependent visa

Post by ANSridhar » Sat Apr 29, 2017 10:02 pm

I recently transferred over to ILR from Tier 2 general via the 5 year route.

My wife is currently on Tier 2 dependent visa expiring in Aug 2017. As my previous tier 2 had a restriction that I could not be employed as a doctor in training, her dependent visa also has the same restriction.

Now that my ILR doesnt have any restriction, when she renews her tier 2 dependent visa via the PBS route, will the restrictions on her dependent visa be lifted?

Any help with this will be very much appreciated.

Thank you

Ashwin

No, the restrictions will remain in place for her as long as she is a PBS Dependent. This is part of the immigration rules for this category and does not change for her simply because you now have ILR as she will still be holding a visa in the PBS category.

It will reset her clock to zero and a new 5 year residence period (3 x 2.5 year visas) on FLR(M) before shr qualifies for ILR. Shr cannot combine her PBS dependent time with FLR(M) to make up 5 years.
