UPDATE: It seems this applies if your visa expired BEFORE leaving the UK, see below !Events that break continuous residence
• been absent from the UK for a period of more than 6 months at any one time
• spent a total of 18 months outside the UK throughout the whole 10 year period
• left the UK before 24 November 2016 with no valid leave to remain on their departure from the UK , and failed to apply for entry clearance within 28 days of their previous leave expiring (even if they returned to the UK within 6 months )

Last a couple of days, I went to see some immigration solicitors (3) about my ILR. Two of them saying that my 10 years-long residence starts from 7 October 2011, not 13 October 2009.
They point out that I had to apply for a new visa in my country within 28 days after my visa expires, which means that I had to apply for a visa before 28 June 2011. As a result of this, my long residence starts from 7 October 2011. On the other hand, one of the solicitors said to me, my long residence starts from 13 October 2009. Could you please help me out? I am very confused about my situation. When I actually read the guidance, it seems it can start from October 2009.
Please note, I had a combination of visas since 2009 (tier 4 student and tier 4 student dependent)
You have lawful residence if you left the UK before your visa expired and returned wihtin 180 days. See Example 2 on page 14.Michelle0507 wrote:Dear honoured members,

Example 2
An applicant:
• enters the UK on 1 September 2004 with entry clearance as a student which is
valid until 31 October 2005
• leaves the UK on 25 October 2005, before their previous leave expired
• re-enters the UK with valid entry clearance as a student on 5 January 2006
The person had valid leave on the date of their departure and on the date of their
return to the UK, and the time spent outside the UK was less than 6 months.
Continuous residence has been maintained, even though the person entered the UK
with a fresh grant of leave.
u r fully fine everything except u didn't apply with in 28 days. the rules says it doesn't matter u leave the country with valid visa or not but if u make an application with in 28 days of ur current visa expire. thats the main factor over here in ur case. i m sure about it if u can convience the case worker about theirhave exceptional circumstance then they might accept ur case otherwise by black and white rules ur 10 years start from 2011. sorry to say but that what ukba rules said. thnxMichelle0507 wrote:Dear Cr001,

In my opinion, my time period is not broken as I applied within 6 months. When I left the country with a valid visa, and I came to the UK with a clear entry clearance. 2011 visa was a completely new visa, as I successfully graduated from my university during previous visa. You are mistaking the requirements of leaving the UK WITH valid leave and leaving the UK after the leave has expired.
