Tier 2 General to Settlement and Dependent extension

Post by Ehiaghe86 » Mon May 08, 2017 4:18 pm

Hello all,

Please I have a few questions, I would like some clarity on.

Please my hubby is due for ILR next year June 2018 under the Tier 2 General category but I and our child(his dependents) are not, but we all have a valid visa till June 2019.

Questions.
1.) a.)When my hubby applies for ILR next year June 2018, Do we his dependents need to apply for an extension even though we would still have a valid visa under his Tier 2 General category and he would have moved to ILR category?
b.) If we have to extend when he applies for ILR, what form do we fill?
2.) Our child was born in the UK, once my hubby applies for ILR and gets it, does our child automatically qualify as a British Citizen or both parents have to have ILR for the child to qualify ?
3.) If we were to give birth to another child after only my hubby has gotten ILR and I have not gotten mine yet, can that child automatically register as a British or the rule of both parents having to have ILR staus before the child can register as British Citizen applies?

Please would really appreciate answers, have searched everywhere can not seem to find direct answers to my questions.

Thank you

Answered many times in many topics on the forum.
1.) a.)When my hubby applies for ILR next year June 2018, Do we his dependents need to apply for an extension even though we would still have a valid visa under his Tier 2 General category and he would have moved to ILR category?
No need to change visas, you can continue as a PBS dep until you meet the requirements for ILR on Set(O).
b.) If we have to extend when he applies for ILR, what form do we fill?
See above.
2.) Our child was born in the UK, once my hubby applies for ILR and gets it, does our child automatically qualify as a British Citizen or both parents have to have ILR for the child to qualify ?
No not automatically but they do have an entitlement to register as British on form MN1 under section 1(3) of the BNA as soon as ONE parent has ILR.
3.) If we were to give birth to another child after only my hubby has gotten ILR and I have not gotten mine yet, can that child automatically register as a British or the rule of both parents having to have ILR staus before the child can register as British Citizen applies?
Child will be British automatically if born AFTER hubby gets ILR. Apply for passport directly with proof of ILR.
