IS.96 and outstanding application

Post by Kumalumajuma » Sun May 07, 2017 2:27 pm

Hello,

I'm hoping to get some information, as I've briefly consulted a solicitor and can't seem to get a straight answer.

backstory: I made an application to stay in the UK, although I used the wrong form and incorrectly filled out some information, so my application was refused on January 24 (letter received on January 27, sent signed for but no one was available when it was delivered/no proof of delivery). I received an IS.96 on the same day, but I submitted an updated application 7 days after the original refusal.

I'm required to report to the police station every two weeks. My solicitor said that once the application showed up in the system that they would release me from reporting, but I am still required to go even though they say they can see that I have a valid application?

Is there any way to get out of the reporting as I have a valid application (as periods of 14 days or less are ignored per the application guidance)?

Any help is much appreciated :)

Well the law permits the secretary of State to impose temporary admission or release on you, if you cease to have leave to remain.

I don't know why some lawyers cannot simply be honest and tell you fact, rather than what you want to hear.

You will not be released from temporary admission , until you are issued leave to remain.

You may seek variation of the terms of Temporary admission, but for him or her to say it will cease, is wrong.

Well that sucks, but thanks for letting me know.

Do you know how to change the terms? I can't find any guidance on this anywhere.

It's all unclear at times as the guidance seems different to what I have going on.

They won't release you from temporary admission as Obie said. However, they may change your schedule. It depends on the application you submitted.
Initially, I had to report every 2 weeks. Now I have to report every 2 months.

Variation- FEE TAKEN AND NEW ACKNOWLEDGEMENT RECEIVED!!!!

Post by Kumalumajuma » Wed May 10, 2017 10:28 am

Hi all!

I submitted a variation on my application (with cover letter explaining as such); as per guidance by a volunteer immigration advisor, I filled out the payment details of the form so that it would not be rejected.

The new fee has been deducted (original application submitted 4/2/17, variation mailed 26/4, received by UKVI on 27/4, fee deducted 28/4).

Today I received a new acknowledgement letter and a new biometrics form. Is this correct? Do I need to call and sort this out, write them, etc??

Many thanks!

Sort what out? You get this for each application you make and are required to submit biometrics.

according to the UKVI guidance, an applicant can only have one outstanding application at a time.

Therefore the fee for the variation shouldn't have been taken. I'm okay with submitting the biometrics again, but now I have two open case numbers rather than one. It's a bit confusing.
