how long can you stay in the UK if you file for divorce?

Hello everyone,

I'm on a UK spouse visa and considering filing for divorce. I would like to know how long I can stay after filing?

You are married until the date of your decree absolute.

Your spouse however has an obligation to inform HO that the marriage is no longer subsisting and HO will curtail/cancel your visa regardless of whether your divorce is finalised or not.

Just want to see how long can you stay if your filing for divorce. Can you stay during the proceedings? Or can you stay until the marriage visa is up?

As Casa has already stated, your spouse is required to inform HO of the breakdown in marriage on the prescribed form. How long HO takes to cancel/curtail your visa is anyone's guess.

Don't confuse divorce processes with Immigration rules, they are separate and not linked. If your visa is cancelled and your are told to leave but the divorce is not finalised, you will have to leave.
