Fiancé advice: marriage, work, bank account

Post by spartacist » Thu May 11, 2017 11:43 am

background:
my girlfriend of over 1 year is a non-EEA National, currently living with me in the UK. she is currently here on a tourist visa, and has just over three months left on it. we are engaged, and plan to get married in the coming months

bank account:
she has gone for a job interview today, and is likely to be offered the job. they can't pay cash-in-hand, so they recommended that she open a saving account to receive the payment. i know this will be a difficult thing in and of itself, but my question relates more to how this could affect our 'Family of a Settled Person' visa application when it comes to that

will they be able to find out that she has a bank account, and if so, would that jeopardise our chances of obtaining the visa?

'Family of a Settled Person' visa:
as i mentioned, we are planning to get married in the coming months, and then to apply for a visa. can we apply for the visa while she is here as a tourist, or does she need to be out of the country? and how does the process tend to go?

thanks in advance for any help 8)

How long has she already been in the UK as a tourist? Did she declare you as her boyfriend in her application? How long did she state in her application that her visit would be? To marry here, you are required to give 28 days notice an an HO approved Registry office and present your Passports and visas. They are required to inform HO and this notice period to 70 days to investigate and / or interview each of you separately.

She cannot work. Why go for interviews if she cannot work and there is no guarantee that she will get a spouse settlement visa? She might have difficulty opening a bank account without evidence that she has the right to reside (not a visitor).

No, she cannot apply for a spouse visa in the UK if she is here as a visitor. She must apply from her home country. Do you meet the financial requirement?
