ILR form selection

Hi All,

My wife entered UK in May 2013 as my dependant when I was on Tier 1 General, in 2014 I got ILR and then British Citizenship in 2015.

She has completed first 2.5 years of visa (which she later received as a dependent of ILR holder), she is now on the second 2.5 years visa. My question is that when she will she be eligible for ILR and which form would she need to fill ? my guess is SET(M) form but I am not 100% sure.

If she switched to FLR(M) spouse settlement visa, she has to wait for 5 years in this visa category before she will qualify for ILR on Set(M). You don't state from what date her FLR(M) visa was issued.

Her first FLRM was issued in May-2014 for the duration of 2.5 years and then she just got it renewed for another 2.5 years in Dec-2016.

I also need to find out the number of days she is allowed to stay outside of the UK (leave of absense which does not break continous stay)

She will only qualify for ILR in 2019 on form Set(M).

There is no absence limit for your spouse on a spouse settlement visa.
