ILR

Post by Mainul123 » Mon May 15, 2017 11:45 pm

Dear Sir,

I am employed by the University of Nottingham from May 2012, so this month it would be 5 years TIER 2 (general). However, my dependent have came over here after 1 year, so they have TIER 2 dependent from last 4 year. All of our visa TIER 2 will be expired on 29th September 2017.

Here are the following questions:
(i) I planed to apply for ILR this month, do my dependent need to apply for visa?
(ii) If I got ILR in this month, then which visa I can apply for my dependents if I do not have any job after 29th September 2017?

Yes, your dependant must extend as PBS dependant until eligible for ILR
(ii) If I got ILR in this month, then which visa I can apply for my dependents if I do not have any job after 29th September 2017?
PBS dependant as FLR(M) will not be an option.

Thanks! If FLR(M) is not an option for me if there is no job after September 2017, then what would be possible option for my dependent. How can I keep them here and when they will have their ILR?

Best wishes,
Mainul

You cannot keep your dependants here if you are unable to support them without relying on public funds :!:

PBS Dependent extension. There is no income requirement for this visa extension.

Dear CR001,

If for PBS dependent, there is no income is required, then when they should apply for visa?
This month with me or on September 2017?

Dear Zimba88,

You said I can't keep them without if I am unable to support them without public fund;however CR001 said, no income is required for PBS. So I am totally confused!

Thanks both of you but please little more clarification!

BW,
Mainul

They must apply to extend theit PBS dependent visa before the current visa expires. You are required to show maintenance funds for their visa extension.

Family members can stay here under two paths:

PBS dependant visa: It has maintenance requirement
FLR(M): It has income requirements
