Ilr to Citizenship query

Post by Disfordylan1987 » Thu May 18, 2017 10:33 am

Hi all, been on the forum for a while now and just asking a quick question as the girlfriend is making me wonder what to do! I've been on ilr for just over a year now and will be going for citizenship in over a year I think...does brexit affect indefinite leave at all and do any future possible inmigration changes by the government affect my ilr? I've assured myself having ilr has the security I need and can presume it's pretty similar to citizenship so I don't need to worry! Thanks for any help.

Brexit will not affect your status. It will likely affect EU citizens.

If you have held ILR for over a year, why not apply for citizenship now?

I thought so! So any future changes to immigration wont affect me if i'm a permanent resident? Planning to apply next year as i'm currently saving for my wedding next year and have a holiday booked in August.

Do not mix up the two terms.

ILR is leave issued under the UK Immigration Rules. PR is acquired automatically under EU law.

They have mostly the same effect in UK law (settled status), but are different beings and governed by different laws.

So, do you have ILR or PR?

ILR Is unaffected by Brexit. PR likely will be.

I guess the main query is will I be fine long term with ilr until I choose to become a citizen? I'm presuming it's very rare for the government to revoke ilr? Thanks

What thoughts do you have in regards to PR holders after the Brexit?

You will be fine so long as you are resident in the UK.

If you leave the UK for more than two years, ILR automatically lapses.

You can apply for citizenship through NCS at your council. They also offer a joint citizenship and passport scheme (JCAP). Applying through NCS means you get to keep hold of all your original documents and you can still travel if you wish to.

I wasn't aware of that char! Helping me again just like with my ilr, will look into that...what's the average turnaround on this and can you apply directly to the council?

The steps are as follows :

1. Meet the requirements obviously.
2. Call the NCS at the Council Registry Office to make an appointment to submit (they charge a small fee).
3. Date of application is the date of your NCS appointment, so important for you to have been physically present on the same date 5 years previously.
4. Complete form AN and the fee sheet.
5. Complete the paper passport form you get from Post Office
6. Submit both completed forms with supporting documents at your NCS appointment.
7. NCS will photo copy ALL your original documents and return them to you and send the copies with your applications.
8. Once sent, HO will debit your AN fee and HMPO will debit your passport fee, likely a couple of weeks apart.
9. HO will at some point, usually a few weeks, send you a letter with a barcode to go an enroll your biometrics at the Post Office. You need to take this letter with you.
10. Then you wait. Some have received approval within a couple of months, others have waited a few months.
11. HO will write to you if they need any info but often not. The next letter you should get is the approval letter, standard 2nd class A5 brown envelope so be careful you don't chuck it as it does look like junk mail.
12. You will get a separate letter inviting you to the ceremony, either a pre booked date or a request to call the council to book it. They do private ceremonies too but these cost extra.
13. Once you have attended your ceremony, the council will inform HO and HO will inform HMPO, then your passport will be printed and sent to you, usually within a couple of weeks.
