Soon to be/Divorced Spouse - Advice

Post by agentz619 » Thu May 18, 2017 7:06 pm

Hi

I am writing this on behalf of a family friend. Firstly this male came legally to the UK and went to collage through a Student Visa. He fell in love with a British national who he married and he transferred to a Spouse Visa.

His wife cheated on him and become pregnant with the other mans baby after a year of marriage and then she wanted a divorce. They both finally agreed to divorce after almost 2 years and all the paperwork was being dealt with and he wanted to marry someone else (British national) as they were in love and engaged but were told to wait until the divorce was completed, so were waiting.
Today he was told that his divorce was going to be finalised after he goes and signs the paperwork at Bethnal Green police station in East London (which I found odd), so he went and signed it but then UKBA Enforcement officers arrested him there and then. He was allowed one phone call to his Fiancée and that was it, now he is being transferred to a Detention Centre. His Fiancée and family have tried to get legal counsel for him but they would not allow for us to.

We all are shocked how all this has happened as he had taken onboard all legal advice but still this has happened. Any advice would be helpful.

Thank you

It would appear that his soon to be ex-wife notified the Home Office that the relationship was no longer subsisting. His spouse visa would have become invalid once he separated from his sponsor (wife).

He will only be able to apply for a new spouse or fiance visa from outside of the UK.

You don't state dates of events, but trying to work out the timeline of 1 year marriage, separated for another 2 years, his visa likely expired as it would only have been valid for 2.5 years and he therefore has no status in the UK.
