Renewing Tier 2 visa for a new job

Hi,

I have a Tier 2 (General) visa which is going to expire soon on 10/8/2017. I received a new job offer from another employer and they are happy to sponsor me another Tier 2 (General) visa. However, my new job will only start on 1/11/2017.

Hence, I am planning to go back to my home country in August when my visa expired. I plan to renew my Tier 2 Visa in September in my home country but somebody told me that I will not be able to do that due to the 12 months cooling period. Is the person right ? What is the best thing I can do if I wish to go back to my home country in August and come back in November?

Correct, if you leave and aooly outside the UK you are aybject to the 12 month cooling off period.

you could ask the new employer to issue a cos in august, apply same day for new visa, and then go back home and join in November.

Does anyone know when can an employer start to apply CoS for his/her employee? Is it three months before the start date?
