SET (O) for dependents

Post by robinpaul78 » Fri May 26, 2017 3:12 pm

Hi,

Need some advice and guidance

I have a Tier 1 General Visa (HSMP in 2007 to Tier 1 in 2009 to Tier 1 in 2012 to Tier 1 in 2014... running out in Sep 2017) and will be applying for my ILR end of this month via PEO. Once my case is successfully processed, I plan to submit my wife and my daughter's ILR application via PEO. They are on PBS dependent visa.

When I look at the SET(O) form to be filled only for my dependents application, the sections are a bit confusing. Need some help here.

Section 1 Applicants details ==> Whose details should be the filled here? Me or my wife?
Section 6 Immigration history ==> Whose details should be the filled here? Me or my wife?

Let me know if anyone in this group had filled the SET(O) form only for dependents application to get ILR.

Regards
Robin Paul

Tier I Dependent - Eligibility Clause for Living together

Post by robinpaul78 » Sat May 27, 2017 12:50 am

Hi

Need some help and guidance regarding my spouse's ILR eligibility.

I have a Tier 1 General Visa (HSMP in 2007 to Tier 1 in 2009 to Tier 1 in 2012 to Tier 1 in 2014... running out in Sep 2017) and will be applying for my ILR end of this month via PEO.

My wife is currently on a Tier 1 General Partner Visa (HSMP Partner in 2008 to Tier 1 Partner in 2009 to Tier 1 Partner in 2012 to Tier 1 Partner in 2014 .. running out in Sep 2017). There has been no break in the Visa validity. She moved to UK in June 2008. However between Dec 2009 to Sep 2012, my wife was continuously in India. Post Sep 2012, we were back in London together.

Given the above circumstances, I wanted to know will my wife qualify for the 2 year living together criteria or will she be placed under the 5 year criteria.

Thanks and Regards
Robin Paul

Did she have a break in her visas and applied for a new entry clearance visa from home country before coming back to the UK?

No. There was no break in her visa. She renewed her visa everytime before the previous one got expired. All 4 visa (inital entry clearance and 3 renewals was done from Mumbai).

Would like to thank everyone for this forum. I got my ILR today. Had a PEO appointment in Croydon.

So I am ready to apply for my dependents and would like a confirmation on the above query. Any help will be highly appreciated.
