Settlement Visa - Sole responsibility evidence?

Post by phildooo » Mon May 29, 2017 2:39 pm

Hello everyone,

A brief explanation of our situation here...
I am a male UK citizen, I have been living in China for the past 2 years and am now married to a wonderful Chinese lady who has a 12 year old son. We are looking to settle in the UK and have filled out most of the application etc.

My question is: We need to prove sole responsibility for my wifes son. When she divorced her last husband, they signed an agreement at the Civil Affairs department saying that my wife has custody of her son and his father will pay 800rmb a month (which he never actually paid).

- Is the above mentioned certificate good enough evidence?
- Do you know any other documents we need for evidence?
- Do we need a letter from the father saying we can take my step-son to the UK?
- Do we need to ask the father to admit in writing that he didn't pay maintenance? (if he's willing)
- How can we prove that my wife has solely supported her son since their divorce?

Much appreciate any advice!

Kind Regards,
Phil

Unlikely to be sufficient. She will need more than that and probably an affidavit or some other official document, relinquishing paternal parental responsibility.

@CR001

Thanks for your response. So the father will need to sign a letter saying he wants nothing to do with his child? Seems a bit of a stretch to me. we have collected quite some documents so far as following, can you please check agin if we do need his dad to sign that affidavit(of course we will manage to do it if necessary)

1. we have all the finance document that show we meet the requirement.
2. we have a flat of our own in the UK where we will be staying.
3. A letter from current school showing my wife paid the tuition fee (bank statement also confirms) and has attended all the meetings or activities at the school.
4. A letter from headteacher at the current school indicating that my wife often talks to the teachers about my stepson's education. It is his first year in an all-English school (we are trying to prepare him for UK schooling), so we are always discussing his progress.
5. A letter confirming current schools enrolment. And acceptance letter from UK school
6. Evidence of flight ticket and travelling expense for last year summer camp in the UK we paid for him.
7. Photos of his growing up, of me and him, three of us (my wife, him and myself)together.
8. We are thinking to get the letter from our landlord to confirm that my stepson has been staying with us all the time.*
9. A letter from my wife's mother saying her son stayed with her for one and half years while my wife was in the UK for study from 2009.
10. Medical immunisation records, regular physical check-up before 3.
11. A cover letter from my stepson says he is happy to move to UK and live with us.
12. If it would help, the father would also be happy to write a letter saying that he is happy for my stepson to go to the UK with us. And that he never paid the originally agreed sum of 800rmb a month.

I'm starting to think we need to get a lawyer involved... Do you think that is necessary?
Appreciate your help

Kind Regards,
Phil
