2nd Biometric Letter!

Hey guys,

I received my biometrics letter this morning, stating that I should have received one earlier and missed the 15 day deadline. So I need to get it done ASAP (which is fine, though I didn't receive one earlier)

Another letter attached has the same standard format that most of us have been receiving about not been able to make the decision within 8 weeks. And the reasons mentioned are;

This is because you have failed to enrol your biometric information within the given timeframe.
This is because you have varied the grounds of your application and we must now begin considering it afresh.


Now the second reason given above isn't making sense to me. As I haven't varied my application.

Anyone with similar experience? or Any expert out there who can shed some light on this?

P.S - Also, the letters are dated 17th May. Weird?

It is a generic letter where only the Biometric part applies to you

Full IHS Refund

I know it's been discussed umpteen times on the forum that there is NO CONNECTION between IHS Refund and the outcome of the application but received full IHS refund on 26th May. Anyone aware of any cases where this might NOT be an indication of a refusal?

Exciting times ahead!!!

The point is, if the application is successful then there is no FULL refund of IHS.

You will not be refunded fully if your application is successful. Unfortunately that could be a sign of refusal.

After how many days you enrol for biometric after receiving the letter?

I personally think your application was invalid that's why you have received full refund. You said in another post that you didn't receive 1st biometric and 2nd one was received on 15 May which should have been issued on 12 or 13 may.
I can be wrong but wait for the decision.

Application made: 20/03/2017
Leave to Remain Expired: 21/03/2017
Biometric Letter: 15/05/17
Biometric Given: 24/05/17
Application Rejected: 24/05/17

Received the parcel today with all my documents back apart from Passport. Reason given:
Failure to submit biometric information

Of course, UKVI is wrong here in rejecting the application as I have submitted the biometrics well with in the allowed timeframe. Perhaps, a crossover of dates as I gave my biometrics on the same day as their letter received today. And they clearly issued the letter much earlier than they should have!

I have called UKVI general inquiries team couple of times and everyone had their own share of advice, to say the least. The first one said to submit the new application and explaining the scenario and the second one said to write the letter back to Sheffield explaining the situation and take it from there. The problem with the first one is making a new application and accepting the last one as invalid will make me overstayer from 21/03/17. And that will break my 10 year continuity. (If I am not wrong?)

Have also spoken to a couple of recommended immigration solicitors and as usual, they also had their own piece of advice to offer.

Alright, do we have anyone here gone through similar case? Or any experienced soul would kindly like to shed some light on What are my options moving forward?

Why did you wait till the 24th to enroll your biometrics, knowing that a previous letter had been issued even though not received. You should have done your biometrics as soon as you got the letter on the 15th. You would have only had 10 days from date of letter to do the biometrics.

I had 10 working days from the 15th May which goes until at least 26th May so I enrolled 3 days in advance. Can't go wrong with that, hey!

The reason for waiting till 24th was that I had to submit an additional document which I had ready waiting for the reference number which came with biometrics letter (dated 15th May) delivered to me on 17th May. I dispatched it on 17th itself with first class and planned to give biometrics by 20th. But things didn't go according to plan as Royal Mail tracking service decided not to show it delivered/signed till 23rd to which then I enrolled on 24th as I wanted that document to be there before my biometrics.

They ain't wrong. I told you before that it will be invalid. In 2nd time they normally give 10 days to biometric not 10 working.
May be some senior can help regarding this issue but you are an overstayer from 24th may.
