PBS dependant apply ILR

Hi guys,

I am going to apply ILR soon, I have some questions to ask, here is my situation.

My husband got his ILR recently through tier 2 route. I have PBS dependant visa for 5 years now. We have two children under 18 both born in the UK (My daughter has PBS dependant visa as well, my son has just born hence no visa). Because my country does not recognise dual nationalities, we are going to apply the ILR for our children, not to register as UK citizenship.

My questions are:

1) I wonder if I am eligible to apply ILR as main applicant and my children as dependants.

2) If I am eligible to apply, I plan to apply in person. If I am refused, will home office continue to process my children's applications. If so, what possible results will be for my children. If not, will they refund my children's application fee?

1. Yes if you meet the requirements

2. If yours fails, childrens might fail to. Fees are not refunded if applications are refused.

Hi CR001,

Thank you for your reply. As I worry about my application, I am going to apply ILR in person by myself then make applications for my children if my application granted. When I look at the link https://www.gov.uk/settle-in-the-uk/y/y ... ier-5-visa
It seems that child can not using form SET(O) to make application. Then I google find the link https://www.gov.uk/government/publicati ... -form-setf
I don't know whether this is the correct application form, since there is no direct link from the first link page to the second link. Do you know if this is the correct one?
