Re-entry on Tier 2 ICT long term before completing 5 years

Post by amar1002 » Fri Jun 02, 2017 3:53 pm

Hi All,

I came to UK on Tier 2 ICT short term in May 2012 and after completing 11 months returned to India. Again came back to UK on ICT Long term in May 2013 for the same client and returned to India in Jan 2017.

The validity of long term visa is 5 years but I returned 15 months before completing 5 years on ICT long term visa. Now I am getting another opportunity in UK for a different client.

Can someone please let me know if I am eligible to travel to UK again and work for remaining 15 months?

Note: My sponsorship license was deactivated immediately after I left UK.

If your sponsor is no longer able to sponsor and does not have a sponsor license then you technically no longer have a valid visa as your visa is solely reliant on being sponsored.

Thanks for quick response.
My employer can get a new sponsor license, that's not a problem. My doubt is that with new sponsor license can I get a new visa and work for remaining 15 months or do I need to serve 12 months cooling off period before I return to UK on Tier 2 visa?

New sponsor license and new visa. Likely subject to the cooling off period from when you last left the UK.

I have not changed my employer so It would be a new license issued by the same employer for a different client.

If your employer has to apply for a new sponsor license, you will have to apply for a new visa.
