Gap between primary and dependent ILR eligibility

Post by jinn_baba » Tue Jun 06, 2017 9:08 pm

Hi,
I will be eligible for an ILR based on Tier 2 General in April, 2018. However my dependents won't be until June 2019. Current Extended visa on our BRP is valid till end of March, 2019. As you see there's a gap between dependent's visa expiry and their ILR eligibility in June, 2019. Questions are:
- Can they stay on Tier 2 Dependent Visa if I get an ILR?
- Will I have to file another visa extension for them to cover off two months difference?
- Will any of above reset their 5 year counter?

Thanks much.

Yes.
Yes. But may vary applications to SET(O) if they are undecided when eligible for ILR.

Thanks Vinny!

Tier 2 extension last time took about a month which means they may not be able to vary their application as there still would be a month or so remains in ILR eligibility..

If the extension comes through before she qualifies for ilr, then she has to apply ilr separately. No way around it

You should be aware that your dependent has to apply for a 3 year extension and pay IHS and visa fee accordingly.

Thanks. Yes, that's what I was afraid of but no way around it seems like.
