Spouse Visa for Husband

Hi there,

I am British national graduate student abroad/ freelancer. I've been married for 3.5 years and have a 2-year-old who is also a British national. Now that we have a child and I am graduating soon we are looking to move back to the U.K together. We currently make "collectively" double the financial requirement and have plenty of savings. We were in the U.K together last year on vacation, so he has been issued tourist visas multiple times. I would rather we didn't separate for our son's sake. I will be heading to the U.K next month to start job hunting. What, when and how would be the best way to initiate the paperwork?

Unless you have savings over £62,500 held in an accessible account for a minimum of 6 months, you will either need to show:

1. As the sponsor you have been earning the equivalent of a minimum £18,600 for the 6 month period prior to submitting the application
AND you have a confirmed job offer to start within 3 months of arrival in the UK, again with a wage of £18,600 p.a

2. You re-locate ahead of your husband and once you can submit 6 months of payslips + the corresponding bank statements, you husband can then submit his application.

Would the earnings have to be in my name? Because my husband makes 30+k and I make 20k but in freelance work, I don't have a payslip. If I get an offer could I submit both our bank statements together?

You re-locate ahead of your husband and once you can submit 6 months of payslips + the corresponding bank statements, you husband can then submit his application. 6 months is a long time for my son and I to be away from him if I get a job offer could he not come on a tourist visa and then turn it into a spouse visa once I've met the 6-month requirement. And lastly, what if he applies for a spouse visa first and it is declined, would that jeopardise him getting a visit visa?

1. For a spouse visa from abroad, only YOUR income is counted and relevant, your spouses income is not included.

2. A visitor cannot switch to another visa category within the UK. If he can get a visit visa as he would have to prove he ha strong ties to hone country which would be difficult if wife and child are already in the UK.

3. A refusal should not affect any further applications.

In addition to CR001's advice, if his spouse visa application is refused, it is likely to have an adverse affect on future visitor visa applications, due to his prior intention to settle.
