Child born in UK before either parents had ILR

Hi,

My son born in UK Oct-2016. He got Birth certificate and Indian passport as well and he went to India in Mar-2017.
I am on Tier 2 General visa I would like to keep my sun in India until i get an ILR (Applying an ILR in Jan-2018).
Please can you answer the following questions.

1). Does my Sun can get British Citizenship once i get an ILR?

2). If so please can you share how to apply British Citizenship for my sun from India.

3). Would i face any difficulty when apply child citizenship from India, and how long the process would take.


Please if you could answer the above questions that would be really appreciated.

1. You have to apply to register the child on form MN1 under section 1(3) of the nationality act.

2. Complete form MN1, submit with proof of your ILR status (original BRP and your passport). HO will take whoever long to approve it and send you the registration certificate. Your child will have to enroll biometrics. Once he is British and you have the certificate, you apply for the passport.

3. No but from India it can take a long time.
