Hello

I need help!

I have made an application for naturalisation vis NCS at a register office yesterday. only thing is in light of the Good Character which is making very nervous and took to my keyboard for advice, to enlighten me if possible.


Here's my Immigration history:

-I came to the Uk on 9 January 1995, applied for asylum a week later. on 25 January got married to ex wife an EEA national who joined me from Germany. obtained 5 year visa rom July 1996 to July 2001, during which period she couldn't adapt and went back to France. it was hard for me to visit her there given my visa status and after 2 years of living apart and herself visiting me it took its tall on her and our marriage broke. Funny thing is that i am still legally her husband despite not seeing one another for 20 years.

- 2001, my then solicitor notified HO and made two applications 1- for ILR and the other a reconsideration of my old asylum application.
- 2002, Ilr was refused as ex-wife none Longer exercised her EEA treaty rights. I was not required to leave the Uk pending reconsideration asylum application during which time I went underground fearing deportation from 2002 until 2010.

- 2010, I made an application through new solicitor on the basis of 14 years unlawful residency -
and a SAR request showed that my old application for asylum was refused by default.

- Oct 2011, Granted IlR and did not breach any of the immigration laws and never had a criminal conviction - Clear record!

Now here is my question : According to home office rule I have to show 10 years lawful residency prior to applying. Could you please enlighten me to whether I must wait until 2021 to qualify or would a case worker would take into consideration the length of time I spent in the country?

Your advice is highly appreciated in this very difficult time.

Hello again,

Could somebody help me with this issue please?

I really need this piece of advice- would it better withdrawing my application which sent yesterday through ncs and wait for 4yrs, or try my luck ?

I see members on this forum giving great advice and I would really really do with your expertise. I really don't want to a get a bar for 10 years making the wrong decision, as I had 22 years of tough time with immigration.

Likely you will only qualify in 2021 for citizenship, from the date you were granted ILR.
