Can I get permission to Work?

Hi All Gurus

First of all, thank you to the entire team and members of Immigrationboard.com for such an informative website.


My question is: I am going to put the file on my European wife(I was on tier2, now waiting on 60 days letter ). Do I get the permission to work when I put the file on her behalf?

What do you mean by "put the file on your European wife"?

If you are legally married to an EEA citizen, you have the right to work. When you apply for a Residence Card, the Home Office should issue you with a COA that states that you have a right to work. You can use the CoA to prove your right to work to employers.

Yes, I am legally married to a Portuguese girl. That Marriage has done in India While I was on Tier 2 visa. Now My company license has been revoked and I am waiting for 60 days letter.

1. Am I legally allowed to file in these circumstances?
2. What Documents do we need? as she's is about to travel to the UK, I can ask her to bring those with her?
3. Should I apply for EEA2?or something else?
4. Do I need to maintain any funds?

Yes you can apply but your spouse must be in the UK as a qualified person exercising treaty rights. If your spouse is not resident in the UK yet, you cannot apply.

See #1 above.
3. Should I apply for EEA2?or something else?
A EEA FM residence card yes.
4. Do I need to maintain any funds?
No but see #1 above. You cannot apply if she is not in the UK and not exercising treaty rights. Your income is irrelevant.
