HELP! TIER 2 GENERAL APPLICATION

Post by yaz1989 » Mon Jun 12, 2017 8:52 pm

I am currently in a bit of a panic because of my situation. My main worry is whether I can apply for my new Tier 2 visa (FROM WITHIN THE UK).

I am currently a doctor in the UK, and my current contract ends on the 1st of August.

I have a new job starting on the 2nd of August with another hospital, therefore another sponsor and another CoS.

All the information online I am coming across says I have to leave the UK to reapply for a Tier 2. This is not an option as there is no time between the two jobs, and as the letter of my new sponsor specifies, it would risk patient safety and classifies the job as on the shortage occupancy list.

What is the reasoning behind not being ale to apply from within the UK for my new visa?

I have already sent in an application, and I am due to have a 'premium service appointment' on the 28th of June.

Anyone has any experience with this?

There seems to be contradictory messages from the UK government website:

1. https://www.gov.uk/tier-2-general/switch-to-this-visa

Switch to this visa

Eligibility

You must already be in the UK under any of the following visas or schemes:

Tier 1 visa
Tier 2 (Sportsperson) visa
Tier 2 (Minister of religion) visa
Tier 2 (Intra company Transfer) visa under the Immigration Rules in place before 6 April 2010 and you’re applying to change sponsor
Tier 4 visa - if you have an eligible qualification or you’ve done at least 12 months of a PhD
You can also switch to a Tier 2 (General) visa if you’re:

You must leave the UK and make your Tier 2 (General) application from abroad if you’re not in any of these categories.

ON THE OTHER HAND

2.https://www.gov.uk/government/uploads/s ... _04_17.pdf

You can apply from inside the UK if you have, or were last granted, leave in one of the
categories listed in the table below:

 Any Tier 1 main applicant;
Any Tier 2 main applicant1;
 Tier 4 student2;
 Tier 5 (Temporary Worker) in the Creative and
Sporting sub-category, for a job as a professional
footballer switching into Tier 2 (Sportsperson) only3;
 Dependent partner of a Tier 4 student;
 Representative of an Overseas Business

Which one do I trust?? :shock:

You can apply to change sponsors within the UK.

There is no contradiction.
The first one you are looking at is wrong, as you are not switching into tier 2, you are already in tier 2.

You MUST apply within uk, if u leave uk and try applying from home, there is 1 year cooling off time for u and u cant come back within 1 year.
Get the cos from new employer and apply within 3 months of 2 aug. Apply as early as possible, so u have the new visa before 2 aug and can start work with the new employer on time
