10 YEAR ILR DUE AFTER 30 DAYS OF T1E EXTENSION

Hi EVERYONE,

Thanks for the help you are providing to all, really appreciate it.

Need an advice to deal situation better.

My Tier 1 Entreprenuer visa expires on 25 july 17 and my 10 years is completing on 25 Aug 17.

I am thinking of applying T1E extension on 25 july, wait for Biometric letter and if there is plenty time thn dont go for Biometrics instead book PSC appointment and go over the window on 26 Aug.

Now, my confusion is if I go over the window, would I have to tell them my extension application's reference number as I wouldnt have my passport and any other docs with me.
& what if I never get any letter from HO until 26 Aug as it happened in couple of cases.

secondly if possible how would I be able to get my T1E extension + IHS fees refunded.

You must apply for extension via post. If you vary it to SET(LR) in PSC you will not get a same day result as your documents must be requested to be sent to PSC.

what do you suggest the fastest way to get ILR sorted.

Even if I go to PSC and vary my extension application, wouldn't I still get my result faster then by post.

Vary by post first and then request upgrade to PSC. No guarantee update will be accepted though

Dear Kapdis,
I was exactly in your situation back in october 2016, submitted my Entrepreneur ExT and then after 25 days got the Entrepreneur Ext varied to ILR (LR). I am still waiting on the decision even after waiting 8 long months. Now they have asked me to provide all the documents relating to the Entrepreneur visa for the last 3 years. I had already submitted all the documents along with the entrepreneur ext application form. So replied them and tried to make them aware of this. My point is to get all the required documents sorted out relating your Entrepreneur ext Visa, the possibilities are that you won't get decision on the same day and later on they might ask about the docs relating entrepreneur visa. They might not ask you as I am the only example of this, no body else has asked about the documents so far.

I got my first visa on 5th of July 2007 and I came into UK on 25 August 2007.

When am I eligible for applying 10 Years Long residence SET(LR) application.

No sooner than within 28 days before 25 August 2017. For long residence it starts from date of entry to the UK.

Your 10-year qualifying period starts from either:

-when you arrived in the UK with a visa

-when you were given permission to stay in the UK

-when you were given permission to stay in the UK
This is ONLY applicable if a person was granted leave to remain WITHIN the UK after being an overstayer or and illegal migrant, i.e. Discretionary Leave to Remain.

If you got your visa OUTSIDE the UK and entered on 25th August 2007, YOUR start of the qualifying period is the date you ENTERED the UK.

Read the guidance document, which clarifies this:

There is a qualifying period to complete for a Long Residence application It runs either from
 the date on which you entered the UK with a visa;
or, if you did not enter the UK with such a visa, from
 the date on which you were first granted permission to remain in the UK

Hi All,

Just want to update on my case.

After a long research on visa variation and couple of emails to Home Office.

I submitted my Entrepreneur visa extension by post and waited after a month without giving Biometrics and then went to Premium Service Centre without my passport and other original docs( as it was with them but in different dept.). They checked my dvla for ID verification and let me in.

Caseworker accepted my variation of case application for ILR and processed me for Biometrics, in the end caseworker said that she is satisfied with the application and will grant me ILR but need to see my exit/entry stamps on passport.

Gave me an acknowledgement letter on that day asked me to wait upto 4 weeks

and just after 4 weeks I received my ILR Biometrics card and passport a day later by post.

In the meanwhile I emailed after 3 weeks to homeoffice to refund my fees.

which they did both my visa fees by cheque and IHS via online bank.

I thank all of you for your support in the time of need.

I would have updated about my cases way earlier but for some reason I was blocked from the website.
