Chances of getting a refund for my ILR application?

Hello,

I made a 5 year ILR application and got rejected on 19th May.
Reasons: indefinite-leave-to-remain/5-years-ilr- ... 31552.html

Before making this application I called UKBA contact number for settlements(0300 123 2241) many times for the last 1.5 years(Since I lost the job) (even made a call on 17th May), just to make sure that the 60 day continuity is not broken.

Every time I called the home office representative said that I am suppose to receive a curtailment letter and the 60 day period starts from that point.

I never received such letter and with this confidence I made my application on 19th May and got rejected.

Now I have successfully got my ILR on 10 year route.
Reasons: indefinite-leave-to-remain/10-years-ilr ... 32937.html

My Questions:

1. Can I make this as a point and request a refund for my rejected application? I am even willing to write to my MP. With the date and times I contacted UKBA.

2. Is it worth the effort? Is there an email address or any contact details to make my point with HO?

Your application was refused because of a 60 day gap between employment and a new Application. This is not the same as a 60 day curtailment letter.

You won't get a refund, so pointless trying.
