Family visit visa refused: Appeal rights

Family visit visa refused: Appeal rights

Dear all,
My sister applied for a family visit visa and it was refused twice. Both times citing that documents were missing even though the documents were provided during the visa application. One set of documents (originals) are returned and it is present in that bundle. The other set was an exact replica of the original set. There was no way of this document to not be in that bundle. The first time they claimed the whole bundle was missing so it led me to believe the case worker overlooked the documents not once but twice.

Anyway, we asked for admin review which we got refused. The complaints haven't had a response yet and they keep pushing us away from any form of useful info and keep sending the standard messages.

I contacted my MP who is raising this case with the relevant dept but no progress/reply so far.

The deadline to appeal is in the next couple of days and was wondering if anyone had similar experience or any advice please?

(We do not wish to apply again as it's just a waste of our money travelling to visa appt, fees etc if they are going to be reckless with their jobs. I'd rather they set it right or for an appeal. )

There is no appeal process for visit visas :!:

I had asked the customer services team and they have sent me an email referring to the link to submit an appeal to the First-tier tribunal.

Perhaps, it is another generic response but it is worth trying rather than giving up.

There is no guarantee that another application will end up being another document missing case and I'll be chasing the tail forever.

Any suggestions or advice if the First-tier tribunal will hear it?

I am filling the form now and apparently family visits have a limited right to appeal on human rights ground.

This is when we raise a breach of human rights and certify in the appeal form right explaining how the human rights article (8) ECHR is breached right?

Can you please clarify who is referred as 'they'? The applicant?
