Appeal won

Post by ihcete » Fri Jun 23, 2017 6:42 pm

Hi all.sorry first time user here.i have won an appeal against deportation order and HO has been refused for permission to appeal by both FTT and UT. Home office sent me a letter confirming they will take no further action and reporting restiriction have been lifted.my question is do i need to apply for permanent residency or Home Office should issue me one anyway ?

Many thanks

You need to provide more information on your UK immigration history and what you applied for and appealed and reasons for refusal etc.

What did the letter say that the tribunal sent you if they sent one?

What was the reason for the refusal for PR (if that is what you applied for)?

Has your wife been exercising treaty rights continuously etc?

Tribunal letter said appeal allowed on immigration regulations 2006
Home office refused my application because they argued i havent been in uk 5 years legally and because of my conviction
But judge at the tribunal made the calculation and told home office repesenting officer that i have been in uk 5 years 4 months at least. he asked her is that a mistake or delibarete she just said its a miscalculation your honour
My wife has always worked

I have been told by criminal case work team that i have to apply for PR because i am a family member of EEA national.
But my solicitor reckons we have won the appeal and that is the end of it

It just worries me so much as my father back home is really ill and i want to see him one last time
