Confused by dependency visa

Post by sadAndConfused » Sun Jun 18, 2017 9:16 am

Hello,

I am currently on a PBS Dependant visa which is due to expire in about 2 months time. I was in the UK on a student visa for about 4 years before switching to this visa.

When I applied and was granted this visa, my partner was a Tier 2 migrant, she has since been granted Indefinite Leave to Remain.

I essentially have two questions:
1. I need to apply for a renewal of my dependency visa. Should I apply as a depend of a Tier 2 migrant (as that was the category I originally applied in) or as a dependent of someone with ILR.
2. My understand is to apply for ILR myself I need to be on the dependency visa for 5 years. One my current one I will have been on a dependency visa for just over 2 years. How long will my renewed dependency visa last for? Specifically, will I need to apply for another renewal of the dependency visa before being eligible to settle.

I have a contract of employment in the UK for the next 5 years earning enough to meet the financial requirements.

On what basis did your partner get ILR, 5 years Tier 2 or 10 years long residency??

1. Apply for a PBS dependent visa extension.

2. It will be granted for 3 years. You will also have to pay the IHS of £600 plus the visa fee and you will have to show maintenance funds.

When you qualify for ILR depends on the date your PBS dependent visa is valid from and this will also dictate on whether you will need a further extension later on.

Health Surcharge for Tier 2 dependent

Post by sadAndConfused » Sun Jun 25, 2017 10:51 pm

Sorry if this is the wrong board to post in, it was a little unclear to me which was most appropriate.

I am trying to submit an application to stay in the UK as my wife's dependent. I am currently her dependent and when I became her dependent she was on a Tier 2 (General) visa. Since then she has been granted ILR, but I understand that I still have to submit an application giving details of her Tier 2 visa.

This was all fairly straightforward and upon completing this online application I was redirected to the immigration health surcharge website. It asked for some additional details about her current visa, specifically the expiration date. As the only "visa" she has is her biometric residency permit I entered the expiration date printed on it, which is the end of 2024.

The website is now instructing me to pay £1500. This cannot be correct as the surcharge is £200/year and I will only be issued with at most 3 years leave to remain on the visa I am applying for. I can only assume this amount was calculated based on the "expiration date" I entered for my wife's visa.

However, I can see no way of changing anything I have entered at this point or contacting any one to try and rectify the issue.

Any advice would be greatly appreciated.

Many thanks.
