Urgent! Minimum salary for experienced worker under SOC 2136

Hi

I have secured a job in the UK and my employer is paying me 31000 GBP per annum. But SOC code 2136 states that the minimum salary for an experienced worker should be 31,100 GBP.

I am worried if my Tier 2 (General) visa application will be rejected for this reason. I am assuming the salary offered to me is based on 40 hours a week.

At the moment our solicitors have just put in an request for a RCOS.

My questions are:
- Is there a chance that my RCoS application request might get rejected?
- Or during my visa application process I might get a rejection?
- Do I still have time to speak to my employers and ask them to increase the salary to its minimum amount?

I would really appreciate some insight to my situation as it is urgent. Thanks.

I can't answer your questions, but if I were you, I'd want the company to get that sorted out.

The information says 31,100 not 31,000 so I don't think you/the company should be cutting this so close.

"Minimum appropriate salary rate

New entrant: £24,000, Experienced worker: £31,100" https://www.gov.uk/government/uploads/s ... r_2015.pdf (for those who may be wondering)

But maybe someone else can share their experience.

The current minimum salary for experience workers under SOC 2136 is £32000 p.a. for a 39 hour week. Anything below that salary will almost certainly result in a refusal.

@Imumtaz, do you know if the info. from https://www.gov.uk/guidance/immigration ... illed-work overrides the one in the actual PDF document***?

Also, I noted that the title of the link you shared was "Immigration Rules Appendix J: codes of practice for skilled work" and it did not explicitly say "skill shortage occupation list".

As an eg., I see that "2315 Primary and nursery education teaching professionals" is listed on the "Immigration Rules Appendix J: codes of practice for skilled work", however it is not listed on the SOC:

Experienced salary for the SOC 2136 ( Programmers and software development professionals) is £32K according to below link (updated link May 2017)

The PDF you posted is from November 2015. Newest version of Appendix J can be found at the link I posted above.
